Terms and conditions

This is a pre-release draft and should be reviewed by a qualified legal or privacy professional before publication.
These terms govern your access to the TickSentry website and iOS application. The application is still in development. Final terms, business details, subscription offerings, and jurisdiction-specific provisions must be confirmed before public release.
1. Accepting these terms
By accessing or using TickSentry, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service.
2. What TickSentry provides
TickSentry provides informational tools intended to support visual tick checks, including enhanced camera views, guided check flows, regional seasonal context, and—when enabled—AI-assisted analysis of a still image you choose to submit.
Features may vary by device, region, subscription, development stage, and service availability.
3. Important safety limitation
TickSentry is not a medical, veterinary, diagnostic, or emergency service. Visual prompts and identification results may be incomplete, delayed, or wrong. TickSentry cannot confirm that an object is or is not a tick, determine whether disease has been transmitted, or guarantee that a person or animal is free of ticks.
Do not delay professional care because of TickSentry. If you are concerned about a person or animal, contact an appropriately qualified medical professional, veterinarian, poison information service, or emergency service. Follow authoritative local advice for tick removal and treatment.
4. Your responsibilities
You agree to:
- use TickSentry lawfully and only for its intended purpose;
- supervise camera use and any check involving a child, animal, or another person;
- obtain any permission needed before photographing or submitting an image involving another person;
- independently assess results and seek professional advice when appropriate;
- avoid attempting to interfere with, reverse engineer, overload, or misuse the service; and
- avoid uploading unlawful, harmful, or unrelated content.
5. Accounts and installation identity
The initial application is designed not to require a traditional user account. It may use a random installation identifier to maintain allowances, purchases, security controls, and abuse prevention. You are responsible for access to your device.
6. Subscriptions and purchases
Some features may require an auto-renewing subscription or have usage limits. Prices, billing periods, available features, and renewal terms will be shown before purchase using information supplied by the App Store.
Purchases are processed by Apple and are also subject to Apple’s terms. Unless cancelled at least 24 hours before the end of the current period, an auto-renewing subscription may renew and your Apple account may be charged. You can manage or cancel a subscription through your Apple account settings. Statutory refund rights and Apple’s applicable refund processes are not excluded by these terms.
7. Intellectual property
TickSentry and its original software, design, branding, and content are owned by or licensed to the TickSentry operator and are protected by applicable intellectual-property laws. We grant you a limited, personal, revocable, non-exclusive, non-transferable licence to use the application for its intended purpose under these terms.
Third-party information and source material remain the property of their respective owners. Regional context is a general educational aid and may not represent current local conditions.
8. Availability and changes
We may update, add, suspend, or discontinue features to improve safety, security, performance, legal compliance, or the service generally. Online features can be interrupted by device, network, provider, or maintenance conditions. We do not promise uninterrupted or error-free availability.
9. Disclaimers and liability
To the maximum extent permitted by law, TickSentry is provided on an “as available” basis without guarantees that its prompts, content, or analysis will be accurate or suitable for a particular purpose.
Nothing in these terms excludes, restricts, or modifies a consumer guarantee, right, remedy, or liability that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law. Subject to those non-excludable rights, we are not responsible for indirect or consequential loss arising from use of, or inability to use, TickSentry.
10. Third-party services
TickSentry may rely on services provided by Apple, Cloudflare, and future AI, analytics, diagnostic, or subscription providers. Those services may have their own terms and privacy practices. We are not responsible for third-party services outside our reasonable control.
11. Suspension and termination
We may restrict access to online features where reasonably necessary to address unlawful activity, misuse, security threats, payment issues, or material breaches of these terms. Provisions intended to survive termination—including safety limitations, intellectual property, and liability provisions—continue to apply.
12. Governing law
The final governing-law and dispute provisions will be confirmed before release based on the operator’s verified legal entity and principal place of business. Mandatory consumer protections in your place of residence continue to apply where the law requires.
13. Changes to these terms
We may update these terms as TickSentry develops. The effective date above identifies the current version. If a material change requires your consent, we will request it as required by law.
